A LOCAL LAW REGARDING THE SAFE USE OF SIDEWALKS, STREETS AND HIGHWAYS IN THE VILLAGE.

Section I. Purposes and Legislative Intent. 

The general purpose of this local law is the protection of the public’s use of public sidewalks, streets and highways located in the Village of Grand View-On-Hudson. 

Section II. Responsibility for Maintenance (as amended by Local Law No. 1 of 1992). .

All persons shall keep the sidewalks in front of the premises owned or occupied by them clean and free from snow, ice, defects and obstructions, Said persons shall remove all snow and ice from the sidewalks in front of the premises owned or occupied by them within eight (8) daylight hours after the termination of a snowfall. Defects shall be repaired and obstructions shall be removed from said sidewalks immediately. 

Section III. Littering Prohibited 

No rubbish or trash of any kind, including but not limited to sticks, dirt or rubbish of any kind shall be deposited onto the sidewalk, gutter or street. 

Section IV. Obstructions Prohibited 

A. Any encroachment upon or encumbrance of any part of the sidewalk other than by permit is prohibited 

B. All persons shall keep the sidewalks in front of the premises owned or occupied by them free of vegetation from the easterly edge of said sidewalk to the edge of curb. Branches or other vegetation overhanging sidewalks shall be removed to a height of seventy-eight (78) inches above pavement. 

C. Sidewalks bordering on driveways shall be kept unobstructed and free of vehicles or other equipment or obstructions of any kind. 

Section V. Failure to Comply 

In all cases where the owner or occupant of property fails, neglects or refuses to comply with the provisions of this local law, the Mayor shall have authority to cause such snow and ice or vegetation to be removed or sidewalk repaired or obstructions removed provided the owner of said property is given five (5) days’ written notice that such action will be taken and an opportunity to correct the condition. In the event the property owner does not correct the

condition within said five (5) day period, the Mayor shall have authority to have the condition corrected. The Board of Trustees shall assess the cost of such correction back to the property as a tax lien after the property owner has been given notice of such assessment and an opportunity to be heard at a public hearing. 

Section VI. Penalties for Offenses 

In addition to any other penalty set forth herein, sny person violating any provision of this local law shall be subject to a fine not to exceed Two Hundred Fifty ($250.00) Dollars or imprisonment not to exceed fifteen (15) days, or by both such fine and imprisonment. Each day the violation continues shall be a separate and distinct violation of this local law. 

Section VII. Enforcement 

The Police Department and/or the Code Enforcement Officer for the Village of Grand View-On-Hudson shall have authority to issue appearance tickets for the violation of any of the provisions of this local law.

A LOCAL LAW PROVIDING FOR THE REGULATION OF VEHICLE AND TRAFFIC IN THE VILLAGE OF GRAND VIEW-ON-HUDSON 

Section 1. Speed Limit 

A. A maximum speed of thirty (30) miles per hour is hereby established throughout the Village of Grand View-On-I-Iudson. 

B. A maximum speed of twenty-five (25) miles per hour is hereby established along the entire length of River Road within the Village of Grand View-On-Hudson. 

Section 2. Parking Regulations 

A. The parking of vehicles on public roadways within the Village of Grand View-On Hudson is hereby prohibited between the hours of 2:00 A.M. and 6:00 A.M. 

B. At all times parking is prohibited on the public roadway on the westerly side of River Road. For the purposes of this local law, “public roadway” shall mean the paved portion of River Road and the right-of-way extending for a distance of three feet west of the paved portion of the road. 

C. At all times parking is prohibited on any sidewalk within the Village. 

D. All parked vehicles shall be removed from all Village roadways not more than two (2) hours after snow has begun to fall. 

E. The parking of vehicles so as to obstruct another’s driveway, garage or house entrance is hereby prohibited. No vehicle shall be parked within ten (10) feet of any driveway. 

F. No commercial vehicle, recreational vehicle, bus, house trailer or similar vehicle shall be parked on any roadway or public property within the Village between the hours of 10:00 P.M. and 6:00 A.M. 

G. No inoperative or unlicensed motor vehicle shall be parked on any roadway or public property within the Village. 

H. Automobiles and other vehicles shall not park on Village property except where expressly permitted. 

I. In addition to any other penalties provided by law, any vehicle that is in violation of any of the provisions of this Section may be removed by the Police Department at the owner’s expense. 

Section 2a. Parking Permits 

A. Any motor vehicle on which is clearly displayed a parking permit validly issued by the Village of Grand View-On-Hudson, shall be permitted to park. 

B. The Village Clerk-Treasurer is hereby authorized to issue a parking permit to the owner or resident of any property within the Village of Grand View-On-Hudson, upon application therefor, provided the applicant shows proof, to the satisfaction of the Village Clerk-Treasurer, of the following: 

1. Name, address, telephone numer, email address and motor vehicle registration of the applicant; 

2. That the applicant is the legal owner or resident of a property within the Village; 

3. That the applicant will be residing on the property for the next succeeding calendar year or any portion thereof; 

4, (a) That there is no area on the subject property of sufficient size to park one motor vehicle or 

(b) That for a temporary period of time there is not sufficient room on applicant’s property to park applicant’s vehicles and the vehicles of applicant’s temporary visitors. In such case, the parking permit shall show the date on which the permit shall commence and the date on which it shall end. 

C. Not more than one parking permit shall be issued or in effect for any property for the same period of time. 

D. A parking permit shall automatically expire upon determination made by the Village Clerk-Treasurer that any of the provisions of subdivisions B or C of this Section have been violated. Written notice of such expiration shall be transmitted to the applicant. 

Section 3. Lane Restrictions 

Crossing lanes by one vehicle overtaking another moving vehicle within the Village of Grand View-On-Hudson is prohibited. 

Section 3a. Bicycles and In-Line Skates 

Notwithstanding the provisions of subdivision (B) of Section 1234 of the Vehicle and Traffic Law of the State of New York, persons riding bicycles or skating or gliding on in-line skates upon River Road in the Village of Grand View-On-Hudson shall not ride more than one abreast. 

Riding of bicycles (other than childrens’ tricycles), scooters and all motorized vehicles and equipment are prohibited on all sidewalks within the Village. 

This Section shall supersede any provisions of the Vehicles and Traffic Law of the State of New York that are inconsistent herewith. All other provisions of such Law shall remain in full force and effect. 

Section 4. Excluded Vehicles 

A. Trucks, tractors, tractor-trailer combinations and commercial vehicles other than one-half (1/2) ton panel trucks are hereby prohibited on River Road. 

B. This Section shall not apply to any vehicle making a local delivery nor shall it apply to any omnibus operating upon a regular scheduled route. For the purposes of this Section, “local delivery” shall mean a vehicle depositing merchandise at a residence within the geographical boundaries of the Village of Grand View-On-Hudson or leaving such residence after having made such deposit, 

Section 5. Penalties 

A. Conduct constituting noncompliance with any provision of this Chapter is hereby expressly designated a violation. 

B. Any person found to cominit a violation of any provision of this Chapter shall be subject to a fine not to exceed Two Hundred Fifty ($250.00) Dollars or to imprisonment for not more than fifteen (15) days, or to both such fine and imprisonment, for each violation, or to such other penalties as may be authorized by the Law of the State of New York. 

C. In addition to the foregoing, a violation of any provision of this Chapter is hereby ordained to constitute disorderly conduct, and any person found to violate any provision of this Chapter shall be a disorderly person. 

D. Whenever any motor vehicle is found parked or standing in violation of any provision of this local law, the law enforcement officer shall take its registration nimber, vehicle identification number, description and any other information and shall conspicuously affix to such vehicle an appearance ticket to answer the charge of this local law. 

If there is no response in the Justice Court to the appearance ticket issued, the Court shall issue a Summons to the owner of the motor vehicle to which the appearance ticket was affixed and direct that the same be served upon the owner. In any prosecution charging a violation of this local law, proof that . the vehicle was parked or standing in violation of this local law, together with proof that the defendant nained in the Summons issued by the Court was, at the time of the violation, the registered owner thereof, shall constitute a presumption that the registered owner of such vehicle was the person who parked or placed the vehicle at the point where and for the time during which such violation occurred. In the event the vehicle to which the appearance ticket was affixed is not registered, there shall be a presumption that the owner of the property in front of which the vehicle was parked or standing is the owner of such vehicle and the person who parked or placed the vehicle at the point where and for the time during which the violation occurred. 

Section SA, Penalties 

In addition to any other penalty or proceeding authorized in this local law, any person who violates any provision of this local law shall be subject to a fine not to exceed Two Hundred Fifty ($250.00) Dollars or imprisonment not to exceed fifteen (15) days or to both such fine and imprisonment for each and every violation of this local law. 

Section 5B. Enforcement 

The Police Department for the Village of Grand View-On-Hudson shall have authority to issue appearance tickets for violations of any provisions of this local law.
